By this application, the applicants are seeking regular bail in Crime No. 164 of 2025 registered with Faraskhana Police Station, District Pune, for the offences punishable under Section 109 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 4(25) of the Arms Act and Sections 37(1), 37(2) read with Section 135 of the Maharashtra Police Act.

It is prosecution's case that on 26th August 2025, the applicants and co-accused assaulted the first informant and his friend with sharp SHUBHADA SHANKAR KADAM weapon with the intention to kill them.

It is contention of learned counsel for the applicants that the applicants are behind bars for more than six months. The investigation is completed and charge-sheet has been filed. The applicants have no antecedents. Hence, requested to allow the application. 4.

It is contention of learned APP that the applicants have assaulted the first informant and his friend with sharp weapon. The injury certificate produced on record shows that the injured has suffered grievous injuries. There are specific allegations against the applicant No.2 about the assault. If the applicant is released on bail, he may abscond or threaten the prosecution witnesses. Hence, requested to reject the application. 5.

I have heard both learned counsel, perused charge-sheet and documents produced on record. The investigation is completed and chargesheet has been filed. The applicants have no antecedents. It may take time to conclude the trial. Considering these facts, I pass following order :

ORDER

(i) The applicants viz. Sainath Sanjay Jadhav and Saurabh Rajesh Sathe be enlarged on bail in Crime No. 164 of 2025 registered with Faraskhana Police Station, District Pune, on executing P.R.Bond in the sum of Rs.30,000/- each with one or two sureties in the like amount.

(ii) The applicants shall attend the concerned police station as and when required.

(iii) The applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
