This Court, by an order dated 16/04/2025 was pleased to shown its disinclination to grant bail, and therefore, the learned counsel for the applicant seeks permission to withdrawn the same, with liberty to file after six months and prays for expediting the trial. Accordingly, this Court expedited the trial and directed the trial Court to dispose of the trial at the earliest. The accused is behind bars since 23/09/2023, and accordingly, the application was disposed of as withdrawn, with liberty as prayed for.

Now, the present application is filed by the applicant praying that he be released on bail, as Piyush Mahajan

25-Cr.BA-664-2026 there is no progress in the trial, and the applicant is behind bars since 23/09/2023.

I have perused the order passed by the trial Court, while rejecting the bail application it is specifically observed that, only two witnesses are remained to be examined, and the trial is at the verge of conclusion. Under such circumstances, in my opinion, as the trial is at the fag end, and hardly, two witnesses are remained to be examined by the prosecution, I am not inclined to grant bail to the applicant, however, purpose would be served by requesting the trial Court to conclude the trial within three months. Hence, the following order;-

O R D E R

(i) The trial court is requested to conclude the trial within three months;

(ii) In case, the trial is not concluded within three months, the applicant is at liberty to file fresh bail application before this Court.

In terms of above, the Criminal Application is disposed of.
