Heard learned counsel the Applicant and learned APP for the State.

By this application, the applicant is seeking regular bail in Crime No. 170 of 2025 registered with Upnagar Police Station, Nashik for the offence punishable under Section 310(4), 310(5) of BNS, 2023 and under Sections 3/25, 4/25 and 27 of Indian Arms Act, 1959 and Section 135 of Maharashtra Police Act.

It is prosecution's case that on 26/04/2025, at around 00.13 p.m. Applicant and co-accused were preparing for dacoity. When police intercepted them, they ran away from the spot and in that attempt, co-accused fired on own and injured himself.

It is contention of learned counsel for the Applicant that co-accused Sarthak Hiraman Hire has been released on bail by this Court. Applicant is behind bars around one year. Hence applicant is entitle for bail on principle of parity and requested to allow the application. 5.

It is contention of learned APP that applicant was caught raidhanded by police. He has antecedents. If he is released on bail, he may abscond or threaten prosecution witness and requested to reject the application. 5.

I have heard both learned counsel. Perused charge-sheet and documents produced on record. The co-accused Sarthak Hire has been released on bail, hence, applicant is entitled for bail on ground of parity. 6.

Considering this fact, I pass following order:

ORDER

(i) The Applicant- Hardik Hiralal Beldar @ Hitesh be released on bail in Crime No. 170 of 2025 registered with Upnagar Police Station, Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
