Heard learned counsel for the Applicant and learned APP for the State.

It is contention of the learned counsel for the Applicant that Applicant was released on bail on 17/08/2016 on certain conditions and required to be present before the trial Court on each date, but he remained absent hence NBW was issued against the Applicant and he has been taken in custody and his bail is cancelled.

Learned counsel further submits that the applicant undertakes that he will attend each and every date before the trial Court regularly and requested to allow the application.

Learned APP vehemently opposes to allow the application on the ground that after releasing on bail, Applicant remained absent before

the trial Court, despite direction to attend the dates of trial Court. If he is released on bail, he may abscond and requested to reject the application. 5.

I have heard both learned counsel and perused the documents produced on record.

Offence under Section 353, 332, 323, 504 and 506 of IPC are registered against the Applicant. The Applicant was released on bail on 17/08/2016 on certain conditions and required to be present before the trial Court on each, but he remained absent. Learned counsel for the applicant submits that Applicant undertakes to attend each and every date before the trial Court regularly.

Considering the submissions of the learned counsel for the Applicant, I pass following order:

ORDER

(i) Application is allowed.

((ii) The Applicant- Sagar Datta Yadav be released on bail in Crime No.85 of 2016 registered with Kamshet Police Station, Dist. Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount subject to payment of Rs.1,000/- costs, to be paid to Legal Services Authority.

(iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (v) The Applicant shall attend the concerned Police Station as and when required.

(vi) Bail Application is allowed in the aforesaid terms. (vii) Applicant shall attend the trial Court's date regularly. (SHIVKUMAR DIGE, J.)
