Heard learned counsel for the Applicant and learned APP for the State.

By this application, the applicant is seeking regular bail in Crime No. 124 of 2025 registered with Chichwad Police Station, Pune for the offence punishable under Sections 64(1), 64(2), 75(1) (2), 79, 356(2), 351(2) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS') and under Sections 4,6,8 and 12 of the Protection of Children from Sexual Offences (for short 'POCSO').

It is prosecution's case that Applicant sexually assaulted the first informant on various occasions by threatening her. It is alleged that applicant is brother-in-law of the first informant. It is alleged that

applicant sent nude photos of the first informant to her proposed husband and due to the said photographs, the marriage of the first informant broken.

It is contention of learned counsel for the Applicant that first informant's real sister was wife of the applicant and she committed suicide on 09/04/2025. In the said complaint there is no reference of present crime. After lodging the said complaint, present complaint is filed against the applicant only to involve him in other offence. The relationship between applicant and first informant is consensual. Applicant is behind bars around one year. He has no antecedents and requested to allow the application.

It is contention of learned APP that applicant sexually assaulted the first informant on several times by threatening her and sent her nude photographs to her proposed husband which resulted into breaking up their relationship. If applicant is released on bail, he may threaten first informant and prosecution witnesses and requested to reject the application.

I have heard both learned counsel. Perused charge sheet and documents produced on record. There is delay in lodging the complaint. The first informant is major. To proves the role of the applicant in present crime, evidence is required. Applicant has no antecedents. It may take

time to conclude the trial.

Considering these facts, I pass following order:

ORDER

(i) The Applicant- Raviraj @ Parshuram Bharat Suryavanshi be released on bail in Crime No. 124 of 2025 registered with Chichwad Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall attend the concerned police station, as and when called.

(iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (v) Bail Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
