Applicant seeks bail in connection with Crime No. 58 of 2022 registered with Bazarpeth Police Station, Thane for the offences punishable under Sections 34, 406 and 420 of the Indian Penal Code, 1860 (for short "I.P.C.) and Section 3 of the Maharashtra Protection of Interest of depositors act, 1999,( for short "M.P.I.D.") solely on the ground that applicant has already undergone more than half of the sentence which is prescribed for this offence.

Learned counsel for the applicant has placed reliance on provisions of Section 479 of the BNSS in order to seek bail. 3.

Learned APP, opposed the application the by contending that the offence is serious in nature and amount over of Rs. 01 crores, is involved in this crime. He however, does not dispute the 22nd APRIL, 2026

Perusal of the record indicates that in respect of a single crime recorded against the applicant, he is taking aid of Section 479 of BNSS, Offence charged against the applicant is punishable maximum imprisonment of 07 years, out of 07 years he is undergone 03 years and 10 months. It is not the case of the prosecution that the applicant is convicted herein before in any other crime. Apart from this, Court does not find any reason to deny bail to the applicant.

Hence, the following order:-

ORDER

a) Application stands allowed.

b) The Applicant be enlarged on bail in connection with with Crime No. 58 of 2022 registered with Bazarpeth Police Station on furnishing PR bond of Rs. 30,000/- with one surety in the like amount to the satisfaction of the Trial Court. c) The Applicant to attend the Trial Court on each dates of hearing unless exempted by the Trial Court. 6.
