Heard learned counsel for the Applicant and learned APP for the State.

By this application, the applicant is seeking regular bail in Crime No. 229 of 2025 registered with Aadgaon Police Station, District Nashik, for the offences punishable under Sections 109, 333, 351(3), 352, 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS'). 3.

It is prosecution's case that on 02/07/2025, the applicant and co-accused assaulted the first informant with weapons with intention to kill him. It is alleged that applicant was part of group, who assaulted the first informant.

It is contention of learned counsel for the Applicant that the

entire incident is captured in CCTV footage. In the said footage, Applicant was seen on other side of the road and he has not participated in the assault of the first informant. Applicant is behind bars for more than 10 months. There is no progress in the trial and requested to allow the application.

It is contention of learned APP that applicant was part of group who assaulted the first informant with intention to kill him. If he is released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record. The co-accused having similar allegations, has been released on bail. In the CCTV footage, it is seen that applicant was standing on the other side of the road. Applicant is behind bars for more than 10 months. It may take time to conclude the trial. He has no antecedents.

Considering these facts, I pass following order:

ORDER

(i) The Applicant- Mahesh Bhagwan Korde be released on bail in Crime No. 229 of 2025 registered with Aadgaon Police Station, District Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall attend the concerned police station, as and when called.

(iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (v) Bail Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
