Heard learned counsel for the Applicant and learned APP for the State.

By this application, the applicant is seeking regular bail in Crime No. 229 of 2025 registered with Aadgaon Police Station, Nashik for the offence punishable under Sections 109, 333, 351(3), 352, 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS'). 3.

It is prosecution's case that on 02/07/2025, the co-accused assaulted the first informant with weapons with intention to kill him. It is alleged that the said assault was done on the say of the applicant as the first informant is lawyer who had taken up a case against the applicant. 4.

It is contention of learned counsel for the Applicant that allegations against the applicant that he slapped the first informant. There

are no allegations against the applicant that he assaulted the first informant any weapon. Applicant is 20 years' old. He has no antecedents. He is behind bars around 10 months. It may take time to conclude the trial and requested to allow the application.

It is contention of learned APP that entire incident is captured in CCTV footage. In the CCTV footage it is seen that applicant along with co-accused assaulted the first informant, which shows his involvement in the crime. If he is released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application. 6.

I have heard both learned counsel. Perused charge sheet and documents produced on record. In CCTV footage it is seen that applicant assaulted the first informant with kick blows. Considering this fact, as well as the fact that at the time of incident applicant was 20 years' old, he has no antecedents, he is behind bars around 10 months and it may take time to conclude the trial, I pass following order:

ORDER

(i) The Applicant- Vaibhav@Sarang Bhagwan Gotise be released on bail in Crime No. 229 of 2025 registered with Aadgaon Police Station, Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall attend the concerned police station, as and

when called.

(iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (v) Bail Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
