By this application, the applicant is seeking regular bail in Crime No. 1008 of 2024 registered with Hinjewadi Police Station, for the offences punishable under Sections 74, 64(2)(z), 65(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3(b), 4, 7, 8, 9(M), 10, 12 of The Protection of Children from Sexual Offences (POCSO) Act, 2012. 2.
It is prosecutions case on 13th December, 2024 applicant tried to sexually assault the minor daughter of first informant. 3.
It is contention of learned counsel for the applicant, the applicant is behind bars for more than twenty months and he is more than 60 years' old. He has no antecedents. There is no progress in the trial and requested to allow the application.

It is contention of learned APP along with learned counsel for Respondent No. 2 that the victim was five years' old. The applicant tried to
sexually assault her. If he released on bail, he may abscond or threaten and prosecution witnesses, and requested to reject the Application. 5.
I have heard all learned counsel. Perused charge-sheet and documents produced on record.

There is no medical report of victim. It appears from that, victim refused to undergo medical examination. Applicant is behind bars for more than 20 months. He is more than 60 years' old. There is no progress in the trial. It may take time to conclude the trial. 7.
Considering these facts, I pass following order.
ORDER
(i) The applicant be enlarged on bail in in Crime No. 1008 of 2024 registered with Hinjewadi Police Station, on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.
(ii) The applicant shall attend the concerned police station as and when required.
(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the victim, witnesses or any person concerned with the case.
(iv) The applicant shall not enter in the jurisdiction of Hinjwadi Police Station till conclusion of the Trial.
The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
