By this application, the Applicant is seeking regular bail in Crime No. 173 of 2024 registered with Upnagar Police Station, Nashik, for the offences punishable under Sections 302, 120-B, 144, 148, 149, 504 r/w. 34 of the Indian Penal Code, 1860 (for short "IPC"), Section 135 of the Maharashtra Police Act and Sections 4 and 25 of Arms Act. 2.

It is prosecution's case that on 07.05.2024, applicant and coaccused murdered the friend of the first informant by assaulting him with sharp weapon on account of old dispute.

It is contention of learned counsel for the applicant that the allegations of the assault are against the co-accused Akash and Prem.

There are no specific allegation against the applicant of assaulting the deceased Arman. The co-accused Sumit Jadhav has been released on bail by this Court (Coram : Ashwin D. Bhobe, J.). Hence, the applicant is entitled for bail on principle of parity.

It is contention of learned APP that the applicant was a part of group who assaulted the deceased Arman with sharp weapon and murdered him. The applicant was actively involved in the crime. If he is released on bail, he may abscond and requested to reject the application. 5.

I have heard both the learned counsel. Perused charge-sheet and documents produced on record. The main allegations are against the co-accused Aakash and Prem and two unknown persons. There are no specific allegations against the applicant of assault or committing murder of deceased Arman. To prove the allegations against the applicant, evidence is required. The applicant is behind the bars for around two years. It may take time to conclude the trial and I pass following order.

ORDER

i.

The applicant be enlarged on bail in Crime No. 173 of 2024 registered with Upnagar Police Station, Nashik, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount.

ii.

The applicant shall attend the concerned police station

as and when required.

iii.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. 6.

The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 7.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
