Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No. 607 of 2022 registered with Kondwa Police Station, Pune for the offences punishable under Section 302 read with Section 34 of the Indian Penal Code, 1960 ('IPC' for short).

It is prosecution's case that on 14/06/2022, at around 2.30 p.m., the Applicant and co-accused murdered the deceased on account of dispute over consuming liquor.

It is contention of learned counsel for the Applicant that the Applicant is behind bar for more than three years. There is no progress in

the trial. Applicant has no antecedents. The co-accused, having similar allegations, has been released on bail by this Court and requested to allow the application.

it contention of learned APP that, there are eye witnesses to the incident. The Applicant had quarrel with the deceased on account of consuming liquor. the Applicant intentionally assaulted on the head of the deceased with wooden stick and tone. If the applicant is released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

It appears from record that the incident happened suddenly. Whether Applicant had intention to kill the deceased or not is part of trial. The Applicant is behind bars for more than three years and eight months. The Applicant has no antecedents. There is no progress in trial. It may take time to conclude the trial.

Considering these facts, I pass following order:

ORDER

(i) The Applicant -Nitin Rambhau Tikole be released on bail in Crime No. 607 of 2022 registered with Kondwa Police Station, Pune on furnishing PR Bond of Rs.25,000/- with one or two solvent sureties in the

like amount.

(ii) The Applicant shall not tamper with the evidence and influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned police station as and when required.
