Heard learned counsel for the Applicant and learned APP for the State.

By this application, the applicant is seeking regular bail in Crime No. 504 of 2025 registered with Nashik Road Police Station for the offences punishable under Sections. 3,5,25 of the Arms Act, 1959 and under Section 142 of the Maharashtra Police Act, 1951. 3.

It is prosecution's case that on 07/10/2025, police intercepted car of the applicant and co-accused and in search of car, police found one country made pistol along with live cartridges. 4.

It is contention of learned counsel for the Applicant that

applicant is behind bars around six months. The country made pistol was found in possession of the co-accused. It may take time to conclude the trial and requested to allow the application. 5.

It is contention of learned APP that Applicant has 15 antecedents. If he released on bail, he may threaten prosecution witnesses or abscond and requested to reject the application. 6.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

Applicant is behind bars around six months. The country made pistol was found in possession of co-accused. It may take time to conclude the trial.

Considering these facts, I pass following order:

ORDER

(i) The Applicant- Ganesh @ Chakulya Madhukar Waghmare be released on bail in Crime No. 504 of 2025 registered with Nashik Road Police Station, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Applicant shall not enter in Nashik District till conclusion of the trial except attending the Court's date.

(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (v) The Applicant shall attend the concerned Police Station as and when required.

(vi) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
