Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No.766 of 2024 registered with Chakan Police Station, District Pune for the offences punishable under Sections 8(c), 20(b)(ii), 20(b), 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "NDPS Act").

It is prosecution's case that on 27th October 2024 Police apprehended the Applicant while roaming suspiciously and Police found 19 kg 624 gms. Ganja in her possession.

It is contention of learned counsel for the Applicant that ganja found in her possession was intermediate quantity. The Applicant is lady and she has no antecedents. She is behind bar for more than 1 year and 4 months. It may take time to conclude the trial and requested to allow the application.

It is contention of learned APP for the State that the Applicant was apprehended by the Police and in her possession ganja was found by Police. If Applicant is released on bail, she may abscond or threaten the prosecution witnesses and requested to reject the application. 6.
I have heard both learned counsel. Perused charge-sheet and documents produced on record. Ganja was found in her possession in intermediate quantity. She is behind bar for more than 1 year and 4 months. She is lady and she has no antecedents. 7.
Considering this fact, I pass following order:
ORDER
(i) The Applicant- Sonali Sunil Mohite be released on bail in Crime No. 766 of 2024 registered with Chakan Police Station, District Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned police station, as and when required.
(v) Bail Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
