By this application, the Applicant is seeking regular bail in C.R.No. 108 of 2024 registered with Khandeshwar Police Station for the offences punishable under Sections 409, 420, 406, 467 and 120(B) of Indian Penal Code, 1860 (for short "IPC").

It is prosecution's case on 27.02.2024, applicant and co-accused in conspiracy induced the first informant to invest the amount on pretext of obtaining benefits under RTGs and income tax concessions. It is alleged that the applicant and co-accused persuaded the first informant to open account in Ramanand Multi-State Co-operative Credit Society Limited, Panvel, obtained signatures of witness Kamal Sancheti on forged bank documents and thereafter withdrew the amount and fled with an amount
of Rs.50 lakhs in cash.

It is contention of learned counsel for the applicant that the coaccused Ganesh Badri, against whom main allegations are levelled, has been released on bail by the Sessions Court and co-accused Dharam Singh has been released by this Court. He further submitted that the allegations against the applicant are that he was present at the time of incident. The applicant has no antecedents. The applicant is behind bars for one year and nine months and requested to allow the application. 4.
It is contention of learned APP that the applicant filled the form of witness Kamal Sancheti in his hand writing. He ran away with Rs.50 lakhs. It shows his involvement in the crime. If the applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the application.

I have heard both the learned counsel. Perused chargesheet and documents produced on record. The co-accused Ganesh Badri and Dharam Singh, against whom similar allegations are levelled have been released on bail. Hence, the applicant is entitled for bail on principle of parity and I pass following order.
ORDER
i.
The applicant be enlarged on bail in C.R.No. 108 of 2024 registered with Khandeshwar Police Station, on
executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount.
ii.
The applicant shall attend the concerned police station as and when required.
iii.
The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. 6.
The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 7.
It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
