Heard learned counsel for the Applicant and learned APP for the State.

By this application, applicant is seeking regular bail in Crime No. 0425 of 2024 registered with Dehu Road Police Station for the offence punishable under Sections 3(5), 103(1) of the Bharatiya Nyaya Sanhita, 2023.

It is prosecution's case that on 19/09/2024, Applicant and coaccused murdered the deceased and thrown his body from hilltop on the ground that the deceased had love affair with the sister of Accused No.1. 4.
It is contention of learned counsel for the Applicant that Applicant and deceased were together for whole day. They had consumed Ganja. Due to sudden quarrel, incident happened. The Applicant is behind bars for more than one year and six months. He has no antecedents and requested to allow the application.

It is contention of learned APP that Applicant and co-accused intentionally murdered the deceased. The Applicant and co-accused caught hold the deceased's legs and hands, whereas accused No.1 strangulated him. There is eye witness to the incident. If applicant is released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

It appears from record that whole day applicant and deceased were together and incident occurred out of sudden quarrel. Applicant has no antecedents. He is behind bars for more than one year and six months. It may take time to conclude the trial.

Considering these facts, I pass following order:
ORDER
(i) The Application is allowed.
(ii) The Applicant- Prem Sachin More be enlarged on bail in Crime No. 0425 of 2024 registered with Dehu Road Police Station, on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.
(iii) The Applicant shall attend the concerned Police Station as and when called.
(vi) The Applicant shall not tamper with evidence or attempt to influence or contact the Complainant, witnesses or any person concerned with the case.
