By this application, the applicant is seeking regular bail in Crime No. 495 of 2025 registered with Dighi police station, District Pune, for the offence punishable under Sections 8(c), 20(b)(ii), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ("NDPS Act") and Section 4(25) of Arms Act and Sections 3(1)(ii), 3(4) of Maharashtra Control of Organised Crime Act, 1999 (for short "MCOC Act"). 2.
It is prosecution's case on 28.08.2024, on secret information police apprehended applicant and in his search, police found 1.05 gm Ganja.

It is contention of learned counsel for the applicant that the Ganja found in the possession of the applicant is small quantity. The
applicant is behind bars for one year and seven months whereas the punishment provided for the offence committed by the applicant is one year only. The applicant has undergoing punishment more than prescribed and requested to allow the application.

It is contention of learned APP that provisions of MCOC Act are applied against the applicant. If he released on bail, he may abscond and requested to reject the application.

I have heard both the learned counsel. Perused chargesheet and documents produced on record. Non commercial quantity Ganja was found in possession of the applicant. He is behind bars for more than one year. Considering these facts, I pass following order:
ORDER
i.
The applicant be enlarged on bail in Crime No. 495 of 2025 registered with Dighi police station, District Pune, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount. ii.
The applicant shall attend the concerned police station as and when required.
iii.
The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 7.
It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
