Heard learned counsel for the Applicant and learned APP for the State.

By this application, the applicant is seeking regular bail in Crime No. 8 of 2025 registered with Khadki Road Police Station, Pune for offences punishable under Sections 109, 118(2), 115(2) ,352, 189(4), 191(2), 191(3), 190 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS'), Section 4(25) of the Arms Act, Section 37(1)(A) r/w. 135 of the Maharashtra Police Act and under Sections 3(1)(II), 3(2) and 3(4) of the MCOC Act.

It is prosecution's case that on 08/01/2025 at around 00.05 a.m., applicant and co-accused assaulted the first informant and his friend

with sharp weapon with intention to kill them. 4.

It is contention of learned counsel for the Applicant that applicant is behind bars for more than one year. The co-accused has been released on bail. The allegations against the Applicant are that he assaulted on the left knee of the first informant. The medical report shows abrasion and not injury on the left knee and requested to allow the application. 5.

It is contention of learned APP that applicant and co-accused assaulted the first informant and his friend with sharp weapon with intention to kill them. If applicant is released on bail, he may threaten prosecution witnesses and requested to reject the application. 6.

I have heard both learned counsel. Perused charge-sheet and documents produced on record. The allegations against the applicant that he assaulted on the left knee of the first informant. The medical report does not show any grievous injury on left knee of the first informant. Applicant is behind bars for more than one year. 7.

Considering these facts, I pass following order:

ORDER

(i) The Applicant- Aditya @ Hanmya Prabhakar Patekar be released on bail in Crime No. 8 of 2025 registered with Khadki Road Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two

solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
