By this Application, the applicant is seeking regular bail in crime No. 88 of 2025 registered with MIDC Sinnar Police Station, Tq. Sinnar, Dist. Nashik for the offences punishable under Sections 310(1), 351(3), 311 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'the BNS' for short) and Section 4/25 of the Indian Arms Act, 1959 (Hereinafter referred to as 'the Arms Act' for short). 2.
It is prosecution's case on 25th February, 2025, the applicant and co-accused robbed the amount kept in petrol pump of the first informant by threatening the employee of petrol pump with sword and sharp weapons.

It is contention of learned counsel for the applicant, the applicant is behind bar more than one year. TIP parade of the applicant is taken, there is no recovery at the instance of the applicant. Hence, requested to allow the application.

It is contention of learned APP that, the applicant has antecedent, he robbed the amount from petrol pump of the first informant.

I have heard both learned counsel, perused the charge-sheet and the documents produced on record. It appears from record applicant has been arrested on the basis of suspicion to prove the case against applicant, evidence is required applicant is behind bar's more than 1 year, there is no recovery at the instance of the applicant and I pass following order.
ORDER
(i) The applicant be enlarged on bail in Crime No. 88 of 2025 registered with MIDC Sinnar Police Station, Tq.- Sinnar, District-Nashik, on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.
(ii) The applicant shall attend the concerned police station as and when required.
(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
