By the present Application, the Applicant seeks bail in Crime No. I-101 of 2020 registered at Igatpuri Police Station, Nashik, for offences punishable under Sections 302, 120(b) read with Section 34 of the Indian Penal Code, 1860 ("for short "IPC") and Sections 3(1)(ii), 3(2) and 3(4) of the Maharashtra Control of Organized Crime Act, 1999 (for short "MCOCA").

Mr V. B. Konde-Deshmukh, learned APP for the RespondentState, raises an objection to the entertainability of the present Bail Application on the ground that the liberty to file a fresh Bail

Application granted to the Applicant must be availed at the first instance before the Trial Court.

Faced with the said objection, Mr. Akshay Bankapur, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw this Bail Application and to approach the Trial Court, in terms of the liberty granted by this Court vide order dated 01.10.2024 passed in Criminal Bail Application No. 2185 of 2024. The said request is not opposed by Mr. V. B. KondeDeshmukh, learned APP for the Respondent-State. 4.

In view of the statement made by Mr. Akshay Bankapur, learned Advocate for the Applicant, leave is granted to withdraw this Bail Application with liberty to file a fresh Bail Application before the Trial Court in terms of the liberty granted in Bail Application No. 2185 of 2024.

If a fresh Bail Application is filed before the Trial Court, the same be considered on its own merits and in accordance with law. Considering the order dated 01.10.2024 passed by this Court in Criminal Bail Application No. 2185 of 2024, if a fresh Bail

Application is filed, the same be considered expeditiously. 6.

Criminal Bail Application No. 1123 of 2026 is disposed of as withdrawn.
