By this Application, the Applicant is seeking regular bail in Crime No.449 of 2025 registered with Yerwada Police Station, Pune, for the offences punishable under Sections 143(2), 143(3), 143(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short) and Sections 75, 80, 81 and 87 of the Juvenile Justice (Care and Protection of Children) Act, 2015.

It is prosecution's case that the Accused Nos.1 and 2 had sold their biological child to Accused No.6. It is alleged that the Applicant and her husband i.e. co-accused No.5 acted as agents in the said transaction.

It is contention of learned counsel for the Applicant that the Applicant's husband has been released on bail. The Applicant is behind bars for more than nine months. The Applicant has no antecedents. There is no progress in trial, and requested to allow the Application. 4.

It is contention of learned APP that the Applicant acted as an agent. The Applicant has received Rs.3,50,000/- as a commission for the sale of the new born baby. If the Applicant released on bail, he may abscond or threaten and prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bars for more than nine months. The co-accused having similar allegations have been released on bail by this Court. The Applicant is a lady.

Considering these facts, I pass following order.

ORDER

(i) The Applicant be released on bail Crime No.449 of 2025 registered with Yerwada Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
