Heard Mr. Aniket Vagal, learned Advocate for the Applicant and Mr. V. B. Konde-Deshmukh, learned APP for the RespondentState.

By the present Application, the Applicant has sought for the following relief in terms of prayer clause b. "He may kindly be released on bail in connection with C.R. No. 547 of 2023 registered with the Dighi Police Station, Pune and in Session Case No. 121 of 2024 pending before the Session Court Pune for the offences punishable u/s.302 r/w. 34 of IPC on such terms and conditions as this Hon'ble Court may deem fit and proper."

Mr. Aniket Vagal, learned Advocate for the Applicant, seeks leave to withdraw the present Bail Application to approach the Trial Court in terms of the order dated 08.09.2025 passed in Bail Application 113 of 2025 (at page no. 65 of paper book). Request made by Mr. Aniket Vagal, learned Advocate for the Applicant is not opposed by Mr. V. B. Konde-Deshmukh, learned APP for the Respondent-State.

In view of the statement made by Mr. Aniket Vagal, learned Advocate for the Applicant, leave is granted to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court.

If a fresh Bail Application is filed before the Trial Court, same be considered on its own merits and in accordance with law. 8.
Criminal Bail Application No. 1194 of 2026 is disposed of as withdrawn.
