Applicant seeks bail in connection with CR. No. 1772 of 2025 registered with Phydhonie Police Station for the offences punishable under Sections 8(c), 21(b) and 29 of the NDPS Act.

In short, it is the case of the prosecution that on 31.12.2025 while patrolling duty accused no.1 was nabbed. Police seized MD (Mephedrone) from him. The present applicant came to be arrested on the ground that present -
Accused No.2 has supplied the said contraband to accused no.1. On conclusion of the investigation, chargesheet came to be filed.

Learned counsel for the applicant submits that there is no contraband recovered from the present applicant. It is his further submission that there is absolutely no evidence in order to show the present applicant is supplying the said contraband to the accused no.1. He further submits that recovery of the contraband from co-accused is of noncommercial quantity. It is his submission that rigors of Section 37 of the Act would not apply to the present case. 4.
Learned APP, opposed the application by citing seriousness of the crime.

Prima-facie, perusal of the chargesheet indicate that recovery of the contraband from the present co-accused is of non-commercial quantity as such rigors of Section 37 of the Act would not apply to the present case. Apart from the said fact, there is no criminal history against the applicant. Thus, it
cannot be said that, if enlarged on bail, he commit similar crime.

After conclusion of the investigation, his custody is not necessary by imposing appropriate conditions his presence secured during trial.

Hence, following order:
ORDER
i) Criminal bail Application no. 1202 of 2026 stands allowed, in connection with CR. No. 1772 of 2025 registered with Phydhonie Police Station, the applicant be enlarged on bail on furnishing PR Bond in the sum of Rs. 15,000/- with one surety in the like amount to the satisfaction of the Trial Court.
ii) The Applicant shall attend every date of hearing before the Trial Court, unless exempted by specific order of the Trial Court.
iii) In view of the above, the Bail Application stands disposed of.
