Heard learned counsel for the Applicants, learned APP for the State.

By this Application, the Applicants are seeking regular bail in Crime No. I-440 of 2024 registered with Loni Kalbhor Police Station, Dist. Pune for the offences punishable under Sections 111, 112, 303(2), 61(2), 316(3), 287 and 288 of Bharatiya Nyaya Sanhita, 2023 and Sections 4,5 and 6 of Explosive Substances Act and Sections 3 & 7 of Essential Commodities Act.

It is prosecution's case that Applicants and co-accused committed theft of fuel from the tankers of petrol company. 4.

It is contention of learned counsel for the Applicants that the co-accused who were arrested on the spot, have been released on bail by this Court. Hence, Applicants are entitled for bail on principle of parity. Applicants are behind the bars for more than one year and seven months and requested to allow the Application. 5.

It is contention of learned APP that Applicants ar e the main culprit. The persons who were arrested on the spot were their servants and were working for the Applicants. The Applicants have antecedents. If Applicants are released on bail, they may abscond or threaten the prosecution witnesses and requested to reject the Application. Charge is framed.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The co-accused, having similar allegations, have been released on bail. Hence, Applicants are entitled for bail on principle of parity.

Considering these facts, I pass following order.

ORDER

i.

The Applicant No.1- Vishal Suresh Gosavi, Applicant

No.2 - Abhiman @ Subhash Suresh Ovhal and Applicant No.3 - Akash Sukhdev Ghodke be released on bail in Crime No. I-440 of 2024 registered with Loni Kalbhor Police Station, Dist. Pune, on furnishing PR bond of Rs.25,000/- each, with one or two solvent sureties in the like amount.

ii.

The Applicants shall not tamper with the evidence and/or influence the prosecution witnesses.

iii.

The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

iv.

The Applicants shall attend the concerned Police Station as and when required.

v.
