By this application, the Applicant is seeking regular bail in C.R.No. 130 of 2023 registered with Uttam Nagar Police Station, Pune, for the offences punishable under Sections 307, 506 and 406 of Indian Penal Code, 1860 (for short "IPC").

It is prosecution's case that on 02.12.2023 at 5:30 p.m., applicant assaulted the first informant with knife with intention to kill her on the ground that she refused to marry him. It is alleged that the applicant withdrew Rs.10,000/- from the bank account of first informant by using her ATM card.

It is contention of learned counsel for the applicant that the
applicant is behind the bars for more than two years and four months. There is no progress in the trial. The applicant has no antecedents. The victim is married and she is living with her husband and requested to allow the application.

It is contention of learned APP that the applicant brutally assaulted on the stomach of the first informant with intention to kill her. If he is released on bail, he may threaten first informant and requested to reject the application.

I have heard both the learned counsel. Perused chargesheet and documents produced on record. The applicant is behind bars for two years and four months. The applicant has no antecedents. The first informant is married and is living with her husband. It may take time to conclude the trial. Considering these facts, I pass following order.
ORDER
i.
The applicant be enlarged on bail in C.R.No. 130 of 2023 registered with Uttam Nagar Police Station, on executing P.R.Bond of Rs. 30,000/-, on furnishing one or two sureties in the like amount.
ii.
The applicant shall attend the concerned police station as and when required.
iii.
The applicant shall not tamper with the evidence or
attempt to influence or contact the complainant, witnesses or any person concerned with the case. iv.
The applicant shall not contact the first informant. v.
The applicant shall not enter the area, where first informant resides.

The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 7.
It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
