Heard learned counsel for the Applicant and learned APP for the State.

By this application, the Applicant is seeking regular bail in Crime No. 506 of 2023 registered with Kondhwa Police Station, District Pune for the offence punishable under Section 302 of the Indian Penal Code (for short 'IPC').

It is prosecution's case that Applicant murdered his wife on the ground of quarrel between them.

It is contention of learned counsel fo the Applicant that Applicant is behind bars around three years. The incident occurred out of sudden quarrel. Applicant has no antecedents and requested to allow the

application.

It is contention of learned APP that Applicant brutely assaulted the deceased with wooden-log causing various injuries. It is not a sudden quarrel. Applicant had intentionally murdered his wife. If he is released on bail, he may abscond or threaten prosecution witnesses. 6.

I have heard learned counsel for the Applicant. Perused chargesheet and documents produced on record. 7.

Applicant is behind bars around three years. He has no antecedents. To prove the intention of the applicant to kill the deceased, trial is required.

Considering these facts, I pass following order:

ORDER

(i) The Applicant- Somnath Mahadev Pandgale be released on bail in Crime No. 506 of 2023 registered with Kondhwa Police Station, District Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
