The Applicant seeks interim bail on medical ground relying upon the order passed by the Hon'ble Supreme Court in the case of Satyendar Kumar Jain v. Directorate of Enforcement1. It is contended by relying upon the said order that a Senior Citizen has a right to take treatment of his choice at his own expenses in a private hospital 3.

There cannot be dispute made with regard to the said proposition. The facts of the present case however, indicate that pursuant to the order passed by this Court, the Applicant was referred to Medical Board of Sir J. J. Group of Hospitals with a specific direction to intimate to this Court as to whether the SLP (Crl.) No. 6561 of 2023 decided on 26.5.2023 20th April, 2026.

76-BA-1345-2026.DOC treatment of the Applicant is possible therein. The Report indicates that the treatment is possible. This Court cannot substitute its opinion to the opinion of the Medical Board.

Hence, at this stage, this Court is not inclined to grant any relief.
