Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No. 130 of 2026 registered with Indira Nagar Police Station, Nashik, for the offences punishable under Sections 7, 7A and 12 of the Prevention of Corruption Act, 1988.

It is the contention of the learned Counsel for the Applicant that the Applicant is behind bar for more than 1 month. He is the private person, who accepted bribe amount and supposed to be given to the government servant i.e. accused no.2. and requested to allow the application.

It is the contention of learned APP that the Applicant has played main role in the present crime as the Applicant has accepted bribe of Rs. 20.00 lakhs out of Rs.1.00 crore on behalf of Accused no.2 and supposed to be deliverd the said amount to Accused no.2. Investigation is in progress. Charge-sheet is not filed. If the applicant is released on bail, he may interfere in the investigation and requested to reject the application. 5.

I have heard both the learned counsel. Accused no.2 is the government servant, who has been released on bail. Hence, the Applicant is entitled for bail on the principle of parity. Hence, I pass following order:

ORDER

(i) The Applicant- Amit Hiraman Jadhav be released on bail in Crime No.130 of 2026 registered with Indira Nagar Police Station, Nashik on executing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned police station, as and when required.

(v) Bail Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
