By this application, the applicant is seeking regular bail in Crime No. 136 of 2025 registered with Lonavala Rural Police Station, District-Pune, for the offences punishable under Sections 103(1), 109, 118(1), 115(2), 352, 351(2), 189(2), 191(2), 191(3), 190 and 126(2) of the Bharatiya Nyaya Sanhita, 2023.

It is prosecution's case that on 25th May 2025, the applicant and co-accused murdered the deceased in road rage incident. 3.

It is contention of learned counsel for the applicant that main SHUBHADA SHANKAR KADAM role of assaulting the deceased is attributed to the absconding accusedSHUBHADA SHANKAR KADAM Date: 2026.05.06 10:33:38 +0530 Pradeep Choudhary. The applicant was part of the group but there are no allegations against him of assault on the deceased and allegations against

him are of assaulting other witnesses. The applicant has no antecedents. He is behind bars for more than 11 months. There is no progress in the trial. The co-accused, against whom similar allegation are made, has been released on bail. Hence, requested to allow the application. 4.

It is contention of learned APP that the applicant was part of group. He assaulted passengers and first informant with weapon. There is involvement of the applicant in the assault on the deceased. If applicant is released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record. The main allegations against the coaccused Pradeep Choudhary, who is absconding, are that he assaulted the deceased with rod on his head. The allegation against the applicant is that he was part of the group, who assaulted the co-passengers and halted their vehicles. The applicant is behind bars for more than 11 months. He has no antecedents. The co-accused, against whom similar allegations are made, has been released on bail. Considering these facts, I pass following order:

ORDER

(i) The applicant be enlarged on bail in Crime No. 136 of 2025 registered with Lonavala Rural Police Station, District-Pune, on

executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

(ii) The applicant shall attend the concerned police station as and when required.

(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
