By this Application, the Applicant is seeking regular bail in Crime No.81 of 2026 registered with Kondhwa Police Station, Pune, for the offences punishable under Sections 109(1), 115(2), 118(1), 118(2), 352, 351(2), 189(2), 191(2), 190 of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short), Section 25 read with Section 4 of the Arms Act, 1959 and Sections 37(1)(3) read with Section 135 of the Maharashtra Police Act, 1951. 2.

It is prosecution's case that on 4th February 2026 at around 9.00 p.m., the Applicant and co-accused assaulted First Informant with sharp weapon with an intention to kill him.

It is contention of learned counsel for the Applicant that coAccused Aswar has been released on bail by this Court against whom similar allegations are levelled like the Applicant. The Applicant is behind bars for more than more than two months. There are no allegations against the Applicant in the FIR. The Applicant has no antecedents. There is no progress in trial, and requested to allow the Application. 4.

It is contention of learned APP that the investigation is in progress. The charge-sheet has been filed. Name of the Applicant is mentioned in the FIR. If the Applicant released on bail, he may abscond or threaten First Informant and prosecution witnesses, and requested to reject the Application. 5.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

In FIR, name of the Applicant is mentioned, but no specific role is attributed to him. The co-accused Aswar, against whom the similar allegations are levelled, has been released on anticipatory bail. The Applicant is behind bars for more than two months. The Applicant has no antecedents. There is no progress in trial. It may take time to conclude the trial. 7.

Considering these facts, I pass following order.

ORDER

(i) The Applicant be released on bail in Crime No.81 of 2026 registered with Kondhwa Police Station, Pune on furnishing

PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(vi) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
