By this Application, the Applicant is seeking regular bail in Crime No.115 of 2024 registered with Peth Police Station, Nashik, for the offences punishable under Sections 103(1), 352, 351(1), 351(2), 1(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short). 2.
It is prosecution's case that on 11th July 2024, the Applicant and co-accused murdered the son-in-law of the First Informant on the account of old dispute. It is alleged that the Applicant caught hold the deceased, from backside and the co-accused (husband of the Applicant) stabbed with knife on the vital part of the deceased.

It is contention of learned counsel for the Applicant that the Applicant is lady. The Applicant is behind bars for more than one year and
nine months. She has no antecedents. It may take time to conclude the trial, and requested to allow the Application. 5.
It is contention of learned APP that the Applicant caught hold the deceased and the co-accused stabbed him with knife. It shows involvement of the Applicant in the crime. If the Applicant released on bail, she may abscond or threaten prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bars for more than one year and nine months. The Applicant is a lady and has no antecedents. The main allegations are against the co-accused. Considering these facts, I pass following order. The parity will not be applicable to the co-accused.
ORDER
(i) The Applicant be released on bail in Crime No.115 of 2024 registered with Peth Police Station, Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall attend the concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
