By the present Application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is before this Court seeking Regular Bail in connection with Crime No. 18 of 2025 registered at the Talegaon Dabhade Police Station, Pimpri-Chinchwad, Pune, for offences punishable under Sections 103(1), 61(2), 126(2), 189(1)(2)(4) and 191(3)

read with 190 of the Bharatiya Nyaya Sanhita, 2023 ("BNS" for short), Section 4, 25 of the Indian Arms Act, 1959, Section 37(1) of the Maharashtra Police Act, 1951 and Section 7 of the Criminal Law Amendment Act, 2013. Crime No. 18 of 2025 is registered as Sessions Case No. 49 of 2025 and is pending before the Additional Sessions Judge, Vadgaon, Maval, District-Pune (Sessions Court). 3.

There are 11 accused persons in Sessions Case No. 49 of 2025. Applicant is Accused No. 6. Accused Nos. 7 to 11 are the juveniles.

Case of the prosecution is that the accused persons in conspiracy with each other, gave a dash to the Activa vehicle of Aryan Shankar Bedekar (deceased) and thereafter, mercilessly assaulted Aryan Bedekar. The motive for the assault was the previous enmity. Aryan Bedekar succumbed to the injuries. 5.

Applicant was arrested on 5th February 2025 and has been in jail since then. The Criminal Bail Application at Exhibit - 31, filed by the Applicant in Sessions Case No. 49 of 2025, was rejected by the Sessions Court by order dated 4th April, 2025.

Mr. Satyavrath Joshi, learned Advocate for the Applicant, submits that the Applicant (Accused No. 6) is similarly placed in the crime as Suraj Lakshman Nirmal (Accused No. 3). He submits that this Court has released Suraj Lakshman Nirmal on bail vide order dated 29th July, 2025, passed in Criminal Bail Application No. 2964 of 2025. He submits that, as the allegations against the Applicant and Accused No. 3 are identical, the Applicant is entitled to bail on the ground of parity. He submits that the Applicant has no criminal antecedents. 7.

Mr. A. A. Palkar, learned APP for the State - Respondent, by relying on the record, submits that the allegations against the Applicant (Accused No. 6) are similar to those against Suraj Lakshman Nirmal (Accused No. 3), who is released on bail and as such, the case of the Applicant can be considered on the principle of parity.

Perused the records and the order dated 29th July, 2025, passed in Criminal Bail Application No. 2964 of 2025.

Records indicate that the role assigned to the Applicant (Accused No. 6) is similar to that assigned to Accused No. 3 in the present crime. Material placed on record, prima facie, does not indicate the complicity of the Applicant in the present crime. Accused No. 3 has been released on bail. In view of this, the principle of parity would apply, and the Applicant would be entitled to bail. The Applicant's continued detention in jail pending trial is not warranted.

In the result, the present Bail Application is allowed on the following conditions :- a. Applicant is directed to be released on bail in Crime No. 18 of 2025 registered with Talegaon Dabhade Police Station, Pimpri-Chinchwad, Pune on executing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty-five Thousand Only) with one or two sureties in the like amount to the satisfaction of the Additional Sessions Judge, Vadgaon, Maval, DistrictPune in Sessions Case No. 49 of 2025. b. Applicant shall not, directly or indirectly, make any inducement, threat or promise to any person/s acquainted with the facts of the accusation, to

dissuade that person/s from disclosing such facts to the Court or to any Police Officer.

c.

Applicant shall not tamper with the prosecution witnesses and evidence in any manner.

d.

The Applicant shall, within three days of his release, furnish his mobile / phone number and residential address, along with proof, to the Investigating Officer, Talegaon Dabhade Police Station, Pimpri-Chinchwad, Pune and shall keep the same updated in case of any change thereto.

e.

Applicant shall co-operate in the conduct of the trial in Sessions Case No. 49 of 2025 and shall regularly attend the hearing of the case before the Additional Sessions Judge, Vadgaon, Maval, DistrictPune, on each date, unless exempted from appearance.

Criminal Bail Application No. 2130 of 2026 stands disposed of.
