By the present Application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant seeks bail in C. R. No. 320 of 2025, registered at Chandan Nagar Police Station, Pune, on 13.08.2025, under

Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

Crime No. 320 of 2025 is registered as Sessions Case No. 170 of 2026 and is pending before the Court of the Additional Sessions Judge, Pune ("Sessions Court"). There are two accused in the crime. Applicant is Accused No. 2.

Case of the prosecution is that the Accused in Crime No. 320 of 2025 assaulted Sainath Janrao ("deceased Sainath") with bamboo, fist and kick blows between 8.30 pm and 10.00 pm at Ambedkar Colony, Chandan Nager, Pune. Deceased Sainath succumbed to the injuries sustained in the assault. 5.

Applicant was arrested on 13.08.2025 and remains in jail as on date. Bail Application at Exhibit - 3, filed by the Applicant in Sessions Case No. 170 of 2026, was rejected on 22.04.2026.

Mr. Harish Ghorpade, learned Advocate for the Applicant, submits that there is no material on record to show that

the Applicant assaulted deceased Sainath. He further submits that the CCTV footage, along with the statement of an eyewitness (Aditya Khude), clearly shows that the Applicant reached at the scene of the offence after deceased Sainath was assaulted by Aditya Walekar (Accused No. 1) with a bamboo stick. He further submits that the Applicant has no role in the assault on deceased Sainath.

Mr. A. A. Palkar, learned APP for the State submits that the material on record indicates that the Applicant participated along with Aditya Walekar, who is the main Accused, in the assault on deceased Sainath.

Perused the records with the assistance of the learned Advocates.

Records placed in this Application, particularly the CCTV panchanama dated 16.08.2025 and the statement of the witness (Aditya Khude), prima facie indicate that the Applicant arrived at the scene of offence after the assault on deceased Sainath. The injuries suffered by deceased Sainath, as per the injury certificate dated 24.09.2025, indicate that the injury

sustained by deceased Sainath was caused by a wooden bamboo. The Applicant is not alleged to have been seen or to have used the bamboo. The Applicant has been in jail for almost 9 months. 10.

In view of the above, the custody of the Applicant is not required pending the trial of Sessions Case No. 170 of 2026. 11.

This Application is therefore allowed on the following conditions :- (a) The Applicant shall be released on bail in FIR No.320 of 2025 dated 13.08.2025 registered with Chandan Nagar Police Station, Pune on furnishing a PR bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one or two sureties in the like amount to the satisfaction of the Additional Sessions Judge, Pune in Sessions Case No. 170 of 2026.

(b) Applicant shall not directly or indirectly make any inducement, threat or promise to any person/s acquainted with the facts of the case to dissuade such person/s from disclosing the facts to the Court or any police officer.

(c) Applicant shall not tamper with evidence in any manner. (d) Applicant shall provide the Investigating Officer with his residential address along with proof, his contact number, email and must inform the Investigating Officer of any changes to this information from time to time. (e) Applicant shall cooperate with the Investigating Officer in the process of investigation of the present Crime. 12.

Criminal Bail Application No. 2181 of 2026 is disposed of.
