Heard Mr. Aniket Vagal, learned Advocate for the Applicant and Mr. Amit Palkar, learned APP for the Respondent/State. 2.
By the present Bail Application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant seeks bail in C. R. No. 480 of 2025 registered with Hadapsar Police Station, Pune, for offences punishable under Sections 108, 85, 80, 115(2), 352, and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.
After hearing the matter for some time, Mr. Aniket Vagal, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw the present Bail Application. He, however, requests that the Complainant in the present crime
(2) BA-2193.26.DOCX (Gurusangappa Dandappagauda Myageri) be directed to be examined at the earliest and that liberty be granted to the Applicant to apply to the Trial Court in the event of a change in circumstances.

Mr. Amit Palkar, learned APP for the Respondent/State, on instructions from the Investigating Officer, Hadapsar Police Station, Pune, states that the prosecution will take immediate steps to examine the Complainant in C. R. No. 480 of 2025. However, he submits that the Applicant and other Accused in C. R. No. 480 of 2025 should cooperate in the trial and not seek adjournments. Statement made by Mr. Amit Palkar, learned APP for the Respondent/State, is taken on record.

In view of the statement made by Mr. Aniket Vagal, learned Advocate for the Applicant, leave is granted to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court in the event of a change in circumstances. If a fresh Application seeking Bail is filed before the Trial Court, same be considered on its own merits and in accordance with law. 6.
Criminal Bail Application No.2193 of 2026 is disposed of as withdrawn.
