Perusal of the FIR will demonstrate that the allegation against the applicant is that he took the victim along with him from her residential house on 26/09/2025 in the night at around 9 p.m. and from 27/09/2025 the victim is residing with applicant at his residential house. The allegation is that on 11/12/2025, the applicant established physical relations with the victim against her wish. The age of the victim as on the date of FIR was 16 years 5 months and 26 days. It is apparent from the FIR that she accompanied the applicant for residing with him as per her own wish and that the applicant and victim resided together for around two and half months prior to the date of alleged incident. The applicant is a student of Bachelor of Computer Application (B.C.A.) 5th
02. ABA 01 of 2026.odt Semester. The applicant has annexed timetable of the examination, which has commenced from 31/12/2025 and shall continue till 14/01/2026.

In view of the above, in the considered opinion of this Court, this is a fit case for grant of ad interim protection. Hence, I pass the following order :- (i) In the event of arrest of the applicant in relation to Crime No.1196/2025, registered with Police Station Tirora, District Gondia for the offence punishable under Section 64
(2) of the Bharatiya Nyaya Sanhita (BNS), 2023 read with Section 6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012, he shall be released on bail upon furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one solvent surety in the like amount.
(ii) The applicant shall not tamper with the prosecution evidence. The applicant shall not pressurize or threaten the prosecution witnesses.

This protection shall remain in force till next date of hearing.

The Investigating Officer to serve the respondent No.2/victim before the returnable date.
