This is an application for Anticipatory Bail. 2.

The applicants are apprehending their arrest in Crime No. 57 of 2024 registered at Bolinj Police Station, for the offences punishable under Sections 420, 465, 467 & 468 read with 34 of the Indian Penal Code and Sections 3 and 4 of Maharashtra Protection of Interest of Depositors Act.

The allegations against the present applicants and other co-accused are of defrauding the first informant and his 1/3

relatives to the tune of Rs.1,53,00,000/-.

I have heard the learned counsel for the applicant, the learned APP for the respondent-State and the learned counsel for the first informant.

The learned counsel for the applicants and the learned counsel for the first informant jointly submit that the parties have amicably settled their dispute.

The learned counsel for the first informant has tendered the affidavit of the first informant, the same is taken on record and marked as 'X' for the purpose of identification. The first informant, in his affidavit, has stated that they have received a total sum of Rs.75,00,000/- from the present applicants and he has no objection if the applicants are released on anticipatory bail. 7.

In that view of the matter, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed :

a) The Application is allowed.

b) In the event of arrest of the applicants in connection with Crime No. 57 of 2024 registered at Bolinj Police Station, for the offences punishable under Sections 420, 465, 467 & 468 read with 34 of the Indian Penal Code and Sections 3 and 4 of Maharashtra Protection of Interest of Depositors Act, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.

c) The applicants shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
