Heard the learned counsel appearing on behalf of the applicant.

The applicant is apprehending arrest in connection with Crime No. 309/2025 registered with Police Station, Nandgaon Peth, Dist. Amravati for the offences punishable under Sections 109, 3(5), 191(2), 191(3) and 190 of the Bhartiya Nyaya Sanhita, 2023.

Having heard the learned counsel appearing for the applicant and the learned A.P.P. appearing for the State, it appears that the complainant along with Amol Chude and Rahul Sundarkar was present near Kashinath Maharaj temple. A quarrel took place between the complainant party and the accused party who were five in number including the applicant, on account of rash driving by Krushna Ganesh Chude on his two wheeler which caused inconvenience to the complainant, to which he objected. Thereafter, Rushikesh Amle who is a friend of the

2 71 aba12.26.odt complainant also reached there. Lateron, co-accused Krushna Chude called Rahul Sundarkar and asked him to come near Nandgaon Peth bus stop to talk about the quarrel that took place earlier.

Accordingly, the complainant along with Rahul Sundarkar, Amol Chude and Rushikesh Amle went to the bus stop. The co-accused as well as other two unknown persons were already present there. As soon as the complainant and his friends reached the spot, co-accused Krushna Chude and Rohit Amrute assaulted the complainant on his right hand by means of an Iron Rod whereas, one unknown person gave a knife blow on the stomach of Amol Chude and the another unknown person gave a blow by means of the same knife on the buttocks of Rushikesh Amle and fled away from the spot. The other co-accused persons have been arrested including one person namely Vishal Lodhi, who named the present applicant as another unknown person.

The role assigned to the applicant is that he assaulted the victim by means of knife on his buttocks. 6.

It appears that the investigation in the crime is over. The knife and the iron rod allegedly used in the crime are already recovered. Rather, the police has filed the chargesheet which shows that the investigation is complete. Nothing is required to be seized from the applicant. No purpose will be served by custodial interrogation of the applicant. The applicant undertakes to cooperate in the investigation

In view of the above and considering the submissions, a case is made out for grant of anticipatory bail to the applicant. Hence, the following order : 8.

The criminal application is allowed.

In the event of arrest, applicant- Bablu Ratansingh Lodhi shall be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount in connection with Crime No. 309/2025 registered with Police Station, Nandgaon Peth, Dist. Amravati for the offences punishable under Sections 109, 3(5), 191(2), 191(3) and 190 of the Bhartiya Nyaya Sanhita, 2023. 10.

The applicant shall appear before the concerned Police Station on every Tuesday and Friday for next three weeks and shall co-operate in the investigation. 11.

The applicant shall not indulge in pressurizing the prosecution witnesses and shall not tamper with the prosecution evidence in any manner.
