Heard the learned counsel appearing on behalf of the applicant and the learned APP appearing on behalf of the State.

The applicant is apprehending arrest in connection with Crime No. 577/2025 registered with Police Station, Sakkardara, Nagpur for the offences punishable under Sections 74, 75(2) of the Bhartiya Nyaya Sanhita, 2023. 3.
Perusal of the FIR shows that the victim was the tenant of the applicant. She was residing along with her father, mother and younger brother. On 27.12.2025 at about 11.30 pm, the applicant came to the room of the victim to see whether anybody was present inside the room. Thereafter, on finding nobody in the room, he went outside the room. Again on the same day at about 12.30 in the night, the applicant came to the room of the victim and knocked at the door. When the victim opened the door, the applicant told her that his wife is not at
2 61 aba14.26.odt home and asked for sexual favours. The victim anyhow closed the door, called her parents and informed about the incident. On the next day, the victim lodged the report against the applicant and the aforesaid offence came to be registered against him.

The contention is that rent was due against the victim and her family. When the applicant demanded the rent, the victim threatened to implicate him in a criminal case. The applicant has been falsely implicated in the crime. Therefore, the applicant is entitled for anticipatory bail.

The application is opposed by the State on the ground that there are criminal antecedents against the applicant. The offence committed by the applicant is serious in nature. The investigation is in progress. She prayed for rejection of the application.

It appears that the allegation against the applicant is that he asked for sexual favours from the complainant. When the complainant was alone at home, the applicant knocked at the door and sought for sexual favours. However, there is no allegation of any physical contact made by the applicant to the complainant. Nothing is required to be seized from the applicant. Therefore, custodial interrogation of the applicant will not be required. As far as criminal antecedents of the applicant are concerned, though the applicant was prosecuted for the offence punishable under Section 302 of the IPC, he has been acquitted of the said offence.

The applicant, under the interim order of this Court, attended the concerned police station and cooperated in the investigation. The applicant can be protected by putting him on stringent condition of attending the concerned police station.

Accordingly, the criminal application is allowed. 9.
The ad-interim protection granted to the applicant by this Court vide order dated 09.01.2026 is hereby confirmed on the same terms and conditions except the condition mentioned in para no.9 of the said order. 10.
The applicant shall attend the concerned Police on every Tuesday and Friday between 10.00 am and 12.00 noon till filing of the charge-sheet.

The applicant shall not indulge in pressurizing the prosecution witnesses and shall not tamper with the prosecution evidence in any manner.
12.
The application stands disposed of in the aforesaid terms.
