Heard the learned counsel appearing for the applicants.

The applicant is apprehending his arrest in connection with Crime No. 90/2025 registered with Police Station, Gadchandur, Dist Chandrapur for the offence punishable under Sections 419, 420, 465, 467, 468, 471, 472 r/w Section 34 of the Indian Penal Code.

The allegation against the applicants is that by misrepresentation, the applicants induced the complainant to pay the amount for purchase of chemicals for testing the antique articles possessed by the applicants, so that the same could be sold at a higher price. On the say of the applicants, the complainant transferred the amount from time to time in the account of the other co-accused. 4.
Having heard the learned counsel and having gone through the FIR, it is revealed that there are allegations of inducement of the complainant for transfer of the amount
2 39 aba15.26.odt on various accounts for the abovesaid reasons. Learned APP opposed for grant of interim protection to the applicants.

Issue notice to the non-applicants/State, returnable on 02.02.2026.

Learned APP waives service of notice on behalf of the non-applicants/State.

Considering the fact that no amount has been transferred in the account of the applicants; prima facie, a case is made out for grant of ad-interim protection. 8.
Till the next date, in the event of arrest of applicants - (1) Bharat Ninaji Thakare and (2) Kishor Bapurao @ Bhaurao Gawai in connection with Crime No. 90/2025 registered with Police Station, Gadchandur, Dist Chandrapur for the offence punishable under Sections 419, 420, 465, 467, 468, 471, 472 r/w Section 34 of the Indian Penal Code, they be released on bail on furnishing a PR bond of Rs.25,000/- each (Rupees Twenty Five thousand only) with one solvent surety each in the like amount.

The applicant shall attend Police Station, Gadchandur, Dist. Chandrapur on 19th, 22nd and 29th January, 2026 between 10.00 am and 12.00 pm and cooperate with the investigation.
