DATE : 23 FEBRUARY, 2026 P.C. :- 1) Mr. Mulawkar, learned advocate appearing for the applicant submits that by an order dated 6 May 2025, the applicant's anticipatory bail application was rejected by this Court. He submits that thereafter, on 15 October, 2025, charge-sheet has been filed. He submits that the applicant thereafter applied for anticipatory bail before the Additional Sessions Judge, Pune which was rejected on 16 December, 2025. He submits that as per General Diary of the Police, which is attached at page 66 of the present anticipatory bail application, in paragraph no. 6, it mentions that the present applicant

KVM 2/2 22 - ABA 15 OF 2026.doc has co-operated and the concerned police station does not require the custody of the present applicant. Further, the applicant has already been given notice under Section 35(3) of the BNSS. 2) Learned A.P.P. appearing for the State and on instructions, submits that as per page 66, which is General Diary, the applicant has co-operated and his custody as of date, is not required. 3) The statements of the learned advocates are noted. 4) In view of the statement made by the learned A.P.P. on instructions of Officer, the applicant seeks liberty to apply before the Competent Court for seeking a regular bail for withdrawing the present anticipatory bail application.

5) Liberty as prayed, is granted.

6) The present anticipatory bail application stands disposed of as not pressed.
