Heard the learned counsel appearing for the applicant.

The applicant is apprehending his arrest in connection with Crime No. 738/2025 registered with Police Station, Sadar, Nagpur for the offence punishable under Sections 318(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The allegation against the applicant is that coaccused Santosh Satpute and Mahesh Warghade introduced the complainant with the present applicant. They suggested to invest the amount in the trading profit fund. Accordingly, the complainant invested the amount with the applicant. The amount was paid to one Mr. Baghel by the present applicant after receipt of the amount from the complainant. The contention is that, the amount has not been paid to the applicant by the complainant.

Having heard the learned counsel for the applicant and having gone through the FIR, it appears that an offence under Section 318(1) of the BNS came to be registered against the applicant on the allegation that he along with the co-accused induced the complainant and other persons to invest the amount of Rs.One Crore for getting the profit of Rs.40 lakhs.

Issue notice to the non-applicant/State, returnable on 22.01.2026.
