The applicants are apprehending arrest in connection with crime No. 1047/2025, registered with Police Station, Yavatmal City, for offence punishable under Sections 109, 189(2), 191(2), 191(3), 190, 118(1), 115(2) of the Bhartiya Nyaya Sanhita, 2023.

Issue notice to the non-applicant, returnable on 27.1.2026.

Learned APP waives notice for non-applicant and prays for time to file reply.

Stand over to 27.1.2026.

On the oral request, permission is granted to assist the prosecution.

It is contended that the application filed by applicants for anticipatory bail has been rejected by learned Additional Sessions Judge, since he was not inclined to allow the application considering the allegations levelled against the applicants. It is the contention of the learned counsel for applicants that there is no role attributed to the applicants in the alleged incident of assault.

I have gone through the case record. Bare perusal of the FIR reveals that no specific role has been assigned to the applicants in the alleged incident of assault; perhaps, this fact will be reflected from the case diary which is not before the Court as of today. Considering the allegations made in the FIR, a case is made out for anticipatory bail. Hence, the following order:

ORDER

i) Pending application, in the event of arrest, the applicants be released on furnishing a P.R. Bond of Rs. 25000/- each and one solvent surety each in the like amount.

ii) The applicants shall attend the concerned Police Station on every Tuesday and Friday, between 10.00 a.m. to 12.00 noon, for three weeks.

iii) The applicants shall not enter Kumbharpura ward,

Yavatmal until further orders.

iv) The applicants shall supply copy of the application to the non-applicants.

v) The applicants shall not tamper with the prosecution evidence and shall cooperate in the investigation.
