Heard the learned counsel appearing on behalf of the applicant and the learned APP appearing on behalf of non-applicant/State, assisted by the learned counsel appearing on behalf of the complainant.

The applicant is apprehending arrest in connection with Crime No. 1047/2025 registered with Police Station, Yavatmal City, Yavatmal for the offences punishable under Sections 109, 115(2), 118(1), 189(2), 190, 191(2), 191(3) of the Bharatiya Nyaya Sanhita, 2023.

The complainant is the father of the victim. It appears that on polling day, the applicants and other coaccused persons were enquiring with a woman voter. The son of the complainant intervened and asked them to behave properly with the lady. At that time another coaccused named Mohd. Ajim Mohd. Anis charged towards the son of the complainant to abuse him and assaulted him by means of knife. The son of the complainant
2 63 aba20.26.odt sustained injury near the left eye. Two other persons namely Mohd. Adnan and Mohd. Wasim also sustained injuries in the said incident. All the injured persons were admitted to the hospital. On the complaint of the complainant, the aforesaid offence came to be registered against the applicants and other co-accused.

The role of assault by means of the knife is attributed to co-accused Mohd. Ajim Mohd. Anis. So far as the present applicants are concerned, the role assigned to them is that at the relevant time, they were present in the assembly.

It is contended by the learned counsel for the applicants that the investigation is complete and the charge-sheet is about to be filed. The said fact is confirmed by the learned APP.

The applicants were protected by the ad-interim order of this Court dated 13.01.2026 with a direction to attend the concerned police station. Accordingly, the applicants appeared and cooperated in the investigation. 7.
Considering the fact that the applicants did not assault any person in the assembly and nothing is required to be seized from them, coupled with the fact that the investigation is already complete, a case is made out for confirmation of the ad-interim protection granted to the applicants.

Accordingly, the Criminal Application is allowed. 9.
Ad-interim protection granted by this Court to the applicants vide order dated 13.01.2026 is hereby

The applicants shall attend the concerned Police Station as and when called by the Investigating Officer and shall co-operate the Investigating agency. 11.
The application stands disposed of.
