Mr. S.V. Sirpurkar, Advocate for applicant.
Ms. D.V. Sapkal, APP for non-applicant/State. CORAM : M.W. CHANDWANI, J.
DATE : 13.01.2026.
Heard.
2.
The applicant is apprehending arrest in connection with crime No. 461/2025, registered with Police Station, Khamgaon Rural, Dist Buldhana, for the offences punishable under Sections 105, 325 of the Bhartiya Nyaya Sanhita, 2023.
3.
Issue notice to the non-applicant, returnable on 30.1.2026.
4.
Learned APP waives notice for non-applicant and prays for time to file reply.
5.
The allegations are that the applicant connected electric supply to the naked protection wire and wrapped it around the motor with the intention to prevent theft of the motor. Deceased Sk. Yunus Sk. Janmahmood and his buffalo came in contact with that motor and died on the
44aba22.2026..odt spot.
6.
The contention is that the applicant is an old aged person and there was no intention or even knowledge attributed to the applicant. It is just because the deceased and his buffalo came in contact with the wire that they accidentally died.
7.
Having heard the learned counsel for the applicant, having gone through the FIR and considering the age of the applicant, a case is made out for grant of ad interim protection till the returnable date. Hence, the following order:
ORDER
i) Pending application, in the event of arrest, the applicant be released on furnishing a P.R. Bond of Rs. 25000/- and one solvent surety in the like amount.
ii) The applicant shall attend the concerned Police Station on every Tuesday and Friday, between 10.00 a.m. to 12.00 noon, for two weeks.
iii) The applicant shall not tamper with the prosecution evidence and shall cooperate in the investigation.
