Since both these applications are arising out of the same crime i.e. Crime No.216/2025 registered with Police Station, Padoli, District Chandrapur of the offence punishable under Section 105 of the Bhartiya Nyaya Sanhita, 2023, they are being decided by this common order.

Having heard the learned counsel for the applicants as well as the learned APP for the State and having gone through the record, it is revealed that when deceased Tanmay Pandurang Bhagat went near the field of applicant - Sudhakar for washing his hands and feet, he got

electrocuted and died on the spot. During investigation, it was revealed that the applicant had fenced his field with an iron-wire. To protect the crop from wild animals, he supplied live current to the fence as a result of which the deceased died after touching the said fence. Therefore, the aforesaid offence came to be registered against the applicant - Sudhakar. However, during investigation, it was also revealed that applicant - Pundlik (ABA 26/2026) had also fenced his agricultural field with an iron-wire and supplied live current to the same. Therefore, he was also made an accused in the present crime.

So far as applicant - Pundlik is concerned, prima facie, it appears that deceased Tanmay did not die after coming in contact with the electric current flowing from the field of Pundlik. The applicant was just made an accused on conjecture.

It appears that both the applicants attended the police station under the dictum of this Court and cooperated in the investigation. It is also revealed that the fenced wire and the electric supply wire are already recovered in this crime. Nothing is required to be seized from these applicants. Considering these aspects, a case is made out for confirmation of the ad interim protection.

Consequently, both applications are allowed. Interim protection granted vide order dated 13.01.2026 is hereby confirmed.

The applicants are directed to appear before the investigating officer as and when called by the investigating officer and cooperate in the investigation.
