The applicant is seeking anticipatory bail in connection with Crime No. 371/2025, registered with Police Station Patur, District Akola, for the offences punishable under Sections 64(1), 331(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023. 3.
Issue notice to the non applicant, returnable on 5.2.2026. 4.
Learned APP waives notice on behalf of non-applicant/State.

It is contended that there was consensual sexual relationship between the applicant and the prosecutrix; however, when this came to the knowledge of her brother-in-law, this false report came to be lodged.

From First Information Report, it appears that the alleged incident took place in the house of the victim where

Considering the submission that the applicant and the informant were constantly in touch with each other over phone calls, the possibility of consensual sexual relationship cannot be ruled out, at this stage, without referring the case diary. Hence, a case is made out for ad interim relief. Hence, following order is passed: i) Pending the application, in the event of arrest, the applicant be released on furnishing P.R. bond of Rs. 25,000/- with one solvent surety in the like amount. ii) The applicant shall attend the concerned Police Station every Tuesday and Saturday, between 10.00 to 12.00 hrs. iii) The applicant shall not tamper with the prosecution evidence and shall cooperate in the investigation.
