The applicant is seeking anticipatory bail in connection with Crime No. 408/2025, registered with Police Station Dhamangaon Badhe, District Buldhana, for the offences punishable under Sections 115(2), 118(2), 118(1), 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The contention is that there was a fight between two groups of close relatives of the applicant and the complainant in which the wife and father of the applicant also sustained fracture injury. The applicant himself has also filed a complaint before the police wherein the offences punishable under Sections 115(2),118(1), 189(2), 190, 191(2), 351(2), 352 of the
45aba44.2026..odt Bharatiya Nyaya Sanhita, 2023 came to be registered against the complainant and other family members.

Considering the submission that the group belonging to the applicant has also sustained fracture injury and FIR has also been lodged against the informant herein, a case is made out for ad interim relief. Hence, following order is passed: i) Pending the application, in the event of arrest, the applicant be released on furnishing a P.R. bond of Rs. 25,000/- with one solvent surety in the like amount. ii) The applicant shall attend the concerned Police Station every Tuesday and Saturday, between 10.00 to 12.00 hrs, for two weeks.
iii) Presence of the applicant before Investigating Officer shall be treated as custody in view of provisions under Section 23 of Bharatiya Sakshya Adhiniyam, 2023. iv) The applicant shall not tamper with the prosecution evidence and shall cooperate in the investigation. JUDGE Belkhede
