The applicant is apprehending his arrest in connection with Crime No.408/2025 registered with Police Station, Dhamangaon Badhe, District Buldhana for the offences punishable under Sections 115(2), 118(2), 118(1), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2.

Having heard the learned counsel for the applicant as well as learned APP and having gone through the case diary, it is revealed that there was a fight between two groups of close relatives of the applicant and the informant. Both groups used wooden sticks and assaulted each other. It appears that the informant sustained fracture injury on his hand due to the assault done by applicant-Pradip Shelke. It is also revealed that the wife and the father of the present applicant also sustained fracture injury. A counter FIR has also been lodged by the applicant against the informant herein

30 aba44.26.odt alleging commission of similar offences. The applicant was protected by ad interim order of this Court dated 22.01.2026.

It is reported by the learned Additional Public Prosecutor that the applicant has cooperated in the investigation and the wooden stick has also been recovered. According to the learned Additional Public Prosecutor, no custodial interrogation is required.

Considering the aforesaid aspects, a case is made out for granting anticipatory bail. Hence, the interim protection granted vide order dated 22.01.2026 is hereby confirmed. 5.

The applicant shall attend the concerned police station as and when directed by the investigating officer. With this, the application stands disposed of. (M.W. Chandwani, J.) Wagh
