The applicant is apprehending arrest in connection with Crime No. 485/2025, registered with Police Station Ner Parsopant, District Yavatmal, for the offences punishable under Sections 420, 417, 406, 477-A, read with Section 34 of the Indian Penal Code and under Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999. 3.

Issue notice to the non applicant, returnable on 3.2.2026. 4.

Learned APP waives notice on behalf of non-applicant/State.

It appears that the applicant is apprehending arrest in this crime, being a Director of Ashtavinayak Urban Cooperative Credit Society from the year 2015 till 2022.

The prosecution case is that there were several irregularities in the sanction and disbursement of loan to the

47aba46.2026...odt borrowers which is also reflected in the audit report. 7.

The learned counsel submits that special audit of the society shows that most of the losses are due to non payment of loan by the borrowers. The applicant was director from 2015 till 2022. It is submitted that the other co-accused are protected by way of ad interim order. The present applicant was not named in the FIR and no specific role has been attributed. Considering the allegations and the fact that other co-accused have already been protected, a case is made out for grant of ad interim protection. Hence, following order:

i) Pending the application, in the event of arrest, the applicant be released on furnishing a P.R. bond of Rs. 25,000/- with one solvent surety in the like amount. ii) The applicant shall attend the concerned Police Station as and when directed by the Investigating Officer and shall cooperate with the investigation.
