DATED :- 18.02.2026 The applicant seeks anticipatory bail in connection with Crime No. 1128/2025 registered with Police Station Khadan, Dist. Akola for the offences punishable under Sections 85, 108, 115(2) and 352 of the Bhartiya Nyaya Sanhita, 2023.

Heard the learned counsel for the applicants as well as the learned APP for the State. I have gone through the case-diary.

It appears that the wife of the applicant committed suicide on 21.12.2025. Thereafter, the brother of the deceased lodged the complaint alleging that the husband of the deceased i.e. the applicant is a drunkard and used to beat the deceased for no reason. It appears that at about 10:00 pm on 20.12.2025, the applicant had quarreled with the deceased and also assaulted her. RR Jaiswal

2 61-aba-47-26.odt Therefore, on the intervening night of 21st December,2025 and 22nd December, 2025, she committed suicide by hanging.

There is a close proximity between the alleged incident of beating and harassment by the applicant and suicide committed by the victim. The statement of the witnesses including the relatives of the applicant reveals that the applicant used to beat the deceased; rather due to this reason, the deceased shifted with her family as well as the applicant to her paternal village hoping that the applicant would change. But, still the harassment of the deceased at the hands of the applicant continued.

Considering the nature of allegations, more particularly the proximity of the alleged incident of beating and suicide committed by the applicant, coupled with the fact that the applicant is the husband of the deceased who was supposed to take care of his wife has himself beaten his wife at multiple occasions which led to her committing suicide, no case is made out for grant of extra-ordinary relief of anticipatory bail. Hence, the application is rejected.
