By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.120 of 2025 registered with the Walchandnagar Police Station, Pune Rural, for the offences punishable under Sections 119(1), 118(1), 74, 115(2), 352, 351(2), 351(3), 190, 191(2) and 189(2) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case is set out in Paragraph No.2 of the Order dated 16th December 2025 passed by the learned Additional Sessions Judge, Indapur, District-Pune in Criminal Bail Application No.354 of 2025, which reads as under :- "2.

The brief facts, which led to the filing of the FIR can be summarized as under - That on 18.04.2025 informant Rupali Sul lodged the FIR with Walchandnagar Police Station alleging that at village Jamb, there is a house property bearing No. 163, which is very old one. In the year 2024-25, Government sanctioned financial help under Prime Minister Housing Scheme and therefore, she undertook construction work of the house by demolishing the earlier structure. On 17.04.2025, present applicants and their associates came to the construction site. At that time, applicant Tejaswini snatched gold chain from the neck of Snehal. She also snatched gold Ganthan & ear rings from her neck & ears. Similarly, associate Amol gave a stroke of the spade on the back of Dadasaheb and associate Rahul gave a stroke of knife on his right arm.

Similarly, associate Rahul pressed her breast and associate Ankush showed them an iron rod & also abused. They also threatened to kill informant and the witnesses. Making such allegations, she lodged the FIR and accordingly crime as above came to be registered. The applicants apprehend their arrest in the present crime and therefore, they are seeking protection by way of anticipatory bail."

It is the submission of Ms. Patil, learned Counsel for the Applicant that the Applicant is a woman. There is a cross FIR bearing CR/FIR No.123 of 2023 lodged by one of the family

members of the present Applicant against the First Informant and her family members. She submits that there is a civil dispute pending between the parties.

On the other hand, Ms. Yadav, learned APP, for the Respondent-State, strongly opposes the Anticipatory Bail Application. She submits that the offence is very serious. On instructions, she submits that the Charge-sheet is filed and that there are no other criminal antecedents against the Applicant. 6.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Tejaswini Rahul Bandal, in connection with CR No.120 of 2025 registered with the Walchandnagar Police Station, Pune Rural, she be released on bail on her furnishing PR Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station as and when necessary and shall cooperate

with the investigation.

(c) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
